LEGAL CONSEQUENCES OF THE REFUSAL OF THE REPUBLIC OF AZERBAIJAN to
accept the political-legal succession and the status of a legal successor
are evident:
- During the period from August through October, 1991 a subject of the international
law was dissolved to which Nakhichevan and MK had been passed in 1921;
- From October, 1991 the Republic of Azerbaijan lost its rights to the territories
(these include not only the territories of the former MKAO) passed to the
protection or annexed to the former Azerbaijani Soviet Socialist Republic.
LEGITIMACY OF NKR is ensured not only by the fact that
it was formed during the period from September through December, 1991 the
territories covered by NKR de jure did not belong to AzR, but the Law of the
Soviet Union of April 3, 1990 which entitled MKAO to determine independently
its state-legal status in the event of the dissolution of the USSR.
LEAGUE OF NATIONS was aware of these processes. Not only it did not
recognized the sovereignty of AzR over Karabagh, but also rejected Azerbaijan's
membership in the League in view of the pretension of AzR to the territories
out of its factual control.
