REPUBLIC OF AZERBAIJAN REFUSED TO BECOME LEGAL SUCCESSOR OF AzSSR IN ORDER
TO:
a) avoid any responsibility for the genocide of the Armenians perpetrated
in 1988-1991 in the former AzSSR
b) deprive MKAO of the right to enjoy the Soviet law which allowed MKAO to
leave AzSSR in the event of separation of AzSSR from the USSR
c) bring to naught the status of the Armenians of AzSSR acknowledged as the
second state nation of the Azerbaijani Soviet Socialist Republic in the context
of the Soviet state-legal realities
d) avoid paying compensation to the Armenians who suffered from the massacres
and deportation.
RESOLUTION OF CAUCASUS BUREAU (July 5, 1921) in the political
context acknowledged the Armenians of Azerbaijan as one of the sides of the
conflict around the national-state system of AzSSR ("In light of the
necessity for the national accord between the Moslems and Armenians"…),
às well as recognized the right of the Armenians of Azerbaijan to the national
autonomy in Nagorno Karabagh "with broad rights". The Resolution
defined that the whole of Nagorno Karabagh should be passed to AzSSR (the
territories under the control of NKR constitute only part of Nagorno Karabagh
passed to AzSSR). The USSR which was established after the proclamation of
these documents acknowledged them as legal grounds of the national-state system
of AzSSR.
RESOLUTION OF THE SESSION OF THE OBLAST COUNCIL OF PEOPLE'S DEPUTIES OF
NKAO (February 20, 1988) which was addressed to the Supreme Council of
ArmSSR, AzSSR and USSR with the political request to review and take a positive
decision "on the issue of separation of MKAO from Azerbaijan and its
connection with ArmSSR", was marked as the start of the state-legal internal
dispute of the USSR between the autonomous oblast and a Soviet republic.
REPUBLIC OF AZERBAIJAN: The establishment of the Republic of Azerbaijan which existed during 1918-1920 was the first attempt before Cyprus to create new Turkish states through interventions, deportation and extinction of the non-Turkish people.
